Local History Reproduction Policy
The reproduction of copies from the local history collection is performed by the library staff at the expense of the library. Up to ten copies can be copied per request. The Newport Beach Library does not hold the copyright to materials in the local history collection. It is the responsibility of the user to obtain any necessary permission.
Copyright
Copyright protects the rights of creators of original works including artists, architects, composers, photographers, publishers, singers and writers. Types of works covered include (but are not limited to) drawings, blueprints, maps, paintings, music and lyrics, and literary writings of all kinds, choreographic works, audiovisual works, photographs and all types of sound recordings. For these works, the copyright holder has the exclusive right to reproduce the work, prepare derivative works, distribute and/or sell copies of the original work, and perform or display work publicly. Copyright law provides protection to unpublished as well as published materials.
The copyright law of the United States (Title 17, U.S. Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish photocopies or other reproductions of copyrighted works. One of these specified conditions is that the photocopy or reproduction is not to be “used for any purpose other than private study, scholarship, or research.” If a user makes a request for, or later uses a photocopy or reproduction for purposes in excess of “fair use,” the user may be liable for copyright and infringement. This institution reserves the right to refuse to accept a copying order, if in its judgment the fulfillment of the order would involve a violation of the copyright law.
When a user requests copies, the library does not absolve users of materials from securing permission from copyright owners and payment of such additional fees which owners may require if the library does not own copyright or if the material is not free of copyright restrictions. Users assume all responsibility for questions of copyright and invasion of privacy that may arise in copying and in the use made of the photographic copy.
Use of Materials
Local history materials must be signed out and used at the reference desk. A librarian can assist you with materials available in the locked history section. However, members of the Friends of the Library who present a reference librarian with their Friends of the Library nametag badge may use the key of their own accord and do not need to sign out for materials.
