Request to modify square footage limitations of wall signs of a tenant user previously authorized by Comprehensive Sign Program No. CS2007-001 (PA2007-078). The change is authorized by Chapter 20.67 of the Newport Beach Municipal Code to allow relief of the area limitations of the sign code. This approval will modify a portion of the table matrix of the sign program. The property is located in the RSC (Retail and Service Commercial) District.

 

 

Section 20.93.060 A of the Newport Beach Municipal Code provides that the Planning Director may waive the requirement for a new modification permit application if the changes are minor, do not involve substantial alterations or addition to the plan or the conditions of approval, and are consistent with the intent of the original approval.

 

ACTION:       APPROVED – NOVEMBER 27, 2007  Approval of a change to the table matrix of the comprehensive sign program to modify square footage limitations of wall signs of a tenant user, previously authorized by Comprehensive Sign Program No. CS2007-001 (PA2007-078).

 

FINDINGS

 

1.                  The change to the sign program is minor and will increase the overall number of signs previously authorized by the sign program.

 

2.                  The area of the proposed sign change is minor and within the parameters and authorization granted to the Planning Director by Chapter 20.67, Sign Code of the Newport Beach Municipal Code.

 

CONDITIONS

 

1.                  The Table Matrix of Comprehensive Sign Program No. CS2007-001 is superseded by the attached Revised Table Matrix dated November 20, 2007.

 

2.                  The previous Table Matrix established by CS2007-001 PA200-078, and dated July 9, 2007, is rendered null and void.

 

The decision of the Planning Director may be appealed by the applicant or any interested party to the Planning Commission within 14 days of the decision date.  Any appeal filed shall be accompanied by a filing fee of $600.00.

Discussion

 

The change to the sign matrix increases the maximum area authorized by Chapter 20.67 and the Sign Code affords such discretion to the Planning Director. The area as proposed, primary sign 81 sq. ft., will not exceed the maximum that would be allowed for the primary sign (90 sq. ft.); however, the area proposed for the secondary sign does authorize an increase from 37.5 sq ft to 45 sq. ft.
