Assembly Bill No. 38: Requests for defensible space inspections within Very High Fire Severity Zones due to real estate transactions can be made by contacting the Fire Prevention Division at 949-644-3106.  The cost for the inspection is $219, which is payable prior to the inspection.

Background

California Assembly Bill No. 38 requires local agencies conduct inspections and provide education on fire hardening improvements when real estate transaction occur within a State declared Very High Fire Severity Zone. The following are noted per AB-38:

  • Wildfires have grown larger and have increased in intensity over the last several decades. 
  • More than 2,000,000 California households, approximately one in four residential structures in California, are located within or in wildfire movement proximity of 'high' or 'very high' fire hazard severity zones.
  • There is a pressing need for wildfire prevention and minimization strategies, on an area-specific basis, that combine increased wildfire resistance within developed areas to minimize wildfire impacts with comprehensive vegetation management measures.

Beginning July 1, 2021, at the time of real estate transactions, local jurisdictions are to provide an inspection with documentation for the jurisdiction in which the property is located.
